Until reviewed by an attorney and put into a real signature flow, treat this as reference text only — not a substitute for a signed waiver on file for every discovery flight passenger and enrolled student.
This Liability Waiver, Release of Liability, and Assumption of Risk ("Waiver") applies to your participation in any discovery flight, flight lesson, ground instruction, or other activity offered by Gettysburg Flight School ("the school"), operating at Gettysburg Regional Airport (W05).
1. Acknowledgment of Risk
I understand that general aviation activities, including flight instruction and flight in small aircraft, involve inherent risks, including but not limited to mechanical failure, adverse weather, pilot error, and other factors that can result in property damage, serious injury, or death. I acknowledge that these risks cannot be entirely eliminated no matter how much care is taken.
2. Assumption of Risk
I voluntarily choose to participate in flight training and/or a discovery flight with full knowledge of the risks involved, and I knowingly and freely assume all such risks, both known and unknown.
3. Release of Liability
To the fullest extent permitted by Pennsylvania law, I release, waive, discharge, and covenant not to sue Gettysburg Flight School, its owners, instructors, employees, and any aircraft owner whose aircraft is used in my training, from any and all liability for claims arising from ordinary negligence in connection with my participation in flight training or a discovery flight. This release does not apply to, and does not attempt to waive, liability for gross negligence, recklessness, or willful misconduct, which Pennsylvania law does not allow to be waived in advance.
4. Medical Fitness
I confirm that I am, to the best of my knowledge, physically fit to participate in this activity, and, if required for the activity I am undertaking, that I hold a valid FAA medical certificate or otherwise meet applicable FAA requirements. I agree to disclose any condition that could affect my ability to safely participate.
5. Compliance with Instructions
I agree to follow the instructions of my certified flight instructor and school staff at all times, including pre-flight briefings and in-flight instructions, and understand that the instructor has final authority over the safe conduct of the flight.
6. Insurance
I understand that the school's insurance, if any, may not cover injury to me, and that I am responsible for my own health, accident, or life insurance coverage. Participation in flight training does not provide me with health or life insurance of any kind.
7. Emergency Medical Care
In the event of an accident or injury, I authorize school staff to seek emergency medical treatment on my behalf, and I agree to be financially responsible for any costs of that treatment.
8. Minors
If the participant is under 18 years of age, this Waiver must be read, signed, and agreed to by a parent or legal guardian on the minor's behalf.
9. Severability and Governing Law
If any part of this Waiver is found unenforceable, the remaining parts remain in full effect. This Waiver is governed by the laws of the Commonwealth of Pennsylvania.
10. Acknowledgment
I have read this Waiver, understand its terms, understand that I am giving up substantial legal rights by signing it, and sign it voluntarily.
